In-Court Diversion
Eligibility Criteria
- Diversion is allowed on the same infraction only once every 6 months except Driving While Suspended (DWS) and Minor in Possession of Alcohol (MIP).
- Diversion for DWS or MIP is allowed providing there has been no conviction or diversion for DWS or MIP in the previous 2 years.
- The following charges are NOT ELIGIBLE for the in-court program:
| Speeding - 21mph or more in a 70 mph zone | Speeding - 26mph or more over in a 45-65mph zone |
| Speeding - 16mph or more over in a 30-40mph zone | Speeding - 11mph or more over in a 20-25mph zone |
| Speeding in a Construction Zone | Speeding in a School Zone |
| Driving Under the Influence | Hosting a Party |
| Reckless Driving | Fleeing and Eluding |
| Running a Red Light | Furnishing Alcohol to a Minor |
| Overweight Vehicle | Any commercial vehicle violation |
Any traffic violation occuring in a public park |

Application Process
- Visit the District Attorney's Office on the 4th floor of the County Courthouse OR appear in Court as required.
- Further explanation of the program and costs involved will be provided at that time.
